1. Promotion Rules
1.1. The Hi-Q | Willard Battery Voucher Offer (the “Promotion”) will run from 01 December 2022, until close of business on 28 February 2023 (“Promotion Period”) or while stocks last. No offer will be made before the start date of the Promotion.
1.2 The Promotion is open to all South African citizens or permanent residents who are over 18 years, except directors, members, partners, employees of Hi-Q Automotive (Pty) Ltd (“Hi-Q”) and any of its affiliated companies (collectively referred to as the “Organiser”), and its advertising and/or promotion agencies, consultants and business partners, outlet owners, retailers and wholesalers that form part of the Promotion, including any of their immediate families.
2. Eligibility requirements
2.1. To be eligible to receive the R100 Willard Voucher (“Willard Voucher”), a customer must complete a free battery check in-store at any Hi-Q nationwide.
2.2. The battery check must be completed in-store.
2.3. The customer is required to activate the free battery check by means of scanning the in-store QR code (available at any High-Q) and registering for the free battery check. The customer will be required to provide their contact details on the accompanying website form to activate the free battery check request. Only once the customer has activated the free battery check may they then complete the check and be eligible to receive the free Willard Voucher.
2.4. Upon successful completion of the battery check, the customer will receive one (1) free Willard Voucher that may be redeemed at any Hi-Q within one (1) year of completing the check when purchasing any Willard battery.
2.5. The Willard Voucher is not transferrable, exchangeable or redeemable for cash at Hi-Q stores, either in whole or in part.
2.6. The Voucher is only redeemable in respect of the purchase of any Willard batteries at any Hi-Q store nationwide within one (1) year from the date of issue of the Willard Voucher.
3. General
3.1 In the event of any dispute arising with regard to the Promotion and/or the Terms and Conditions including the interpretation thereof, the Organisers shall be responsible for resolving the dispute (having considered all circumstances applicable to the dispute) and the Organisers in their sole discretion shall be entitled to make a determination regarding the dispute and how it ought to be resolved (“Decision”). The Decision by the Organisers is final, and binding on the parties to the dispute.
3.2 The Promotion is conducted in accordance with the laws of the Republic of South Africa. If any provision of these Terms and Conditions, is rendered void, illegal or unenforceable in any respect under any law, the validity, legality and enforceability of the remaining provisions of these Terms and Conditions shall not in any way be affected or impaired thereby and the Parties shall endeavour in good faith to agree an alternative provision to the void, illegal or unenforceable provision.
3.3 The Organisers reserve the right to amend these Terms and Conditions during the Promotion Period in their sole discretion (without consulting and/or seeking the approval of any holders of the Willard Vouchers), should they deem it appropriate, and any such amendment(s) shall be published on the Hi-Q website (www.hiq.co.za). High-Q shall not be responsible for notifying all the holders of the Willard Vouchers regarding any amendments to these Terms and Conditions and it is the responsibility of the holders of the Willard Vouchers to monitor the High-Q website in respect of the publication of any amendments to the Terms and Conditions.
3.4 The customer acknowledges and hereby consents to the Organisers and the Hi-Q outlets collecting certain personal information about the customer for the purposes of this Promotion, including the customer’s identity/passport number and contact details such as telephone number(s) and email address(es). The Organisers and the Hi-Q outlets undertake not to sell, use or share this information to or with third parties, or for any other purpose other than related to this Promotion, unless we have received your prior written consent, but may disclose the information if required by law.
3.5 The Organisers and/or the Hi-Q outlets may require the customer to be identified and photographed and may publish such photographs in print and/or social media, or to appear on radio and television, when accepting the Willard Voucher. The customer will be given the opportunity to decline the publication of their images and to participate in such promotional marketing material prior to Hi-Q using any material for the purpose as above mentioned.
3.6 The Organisers reserve the right to cancel, suspend or terminate the Promotion at any time. The Organisers shall have no liability whatsoever to the customer and/or third party arising from or as a consequence of such cancellation, suspension or termination.
3.7 Notwithstanding anything to the contrary contemplated in these Terms and Conditions:
3.7.1 neither the Organisers nor the Hi-Q outlets shall be liable for any claims, damages or losses (whether direct, indirect, general, special, incidental, consequential or punitive), expenses or costs (including, without limitation, costs on an attorney and own client scale) or injuries of whatsoever nature (together referred to as “Losses”), suffered by the customer or any third party arising from or as a result of this Promotion (whether directly or indirectly) and/or the customer’s participation in this Promotion; and
3.7.2 the customer indemnifies and holds harmless the Organisers and the Hi-Q outlets against any Losses, howsoever caused or arising.
3.8 The customer accepts and uses the Promotional Voucher at the customer’s own risk and expressly agrees that neither the Organisers nor the Hi-Q stores/outlets will be liable in any way for any costs incurred by the customer in claiming their Willard Voucher.
