Promotional Rules of the Hi-Q Winter Campaign 2018

1. Introduction

1.1. By taking part in this Promotion, each customer (the “customer”) acknowledges his/her understanding and acceptance of and agrees to comply with the terms and conditions set out herein (the “Promotional Rules”).

1.2. The Hi-Q Winter awardscard® Promotion will run from Thursday, 14 June 2018 until close of business on Saturday, 14 July 2018 or while stocks of the awardscards® or Promotional Tyres (defined in paragraphs 2.1.1 and 2.3 below) lasts, whichever occurs first (the “Promotional Period”). No awardscards® will be offered before the start date of this Promotion.

1.3. This Promotion is open to all South African citizens or permanent residents of South Africa, 18 years of age or older, except directors, members, partners, employees (and their respective immediate families) of:

1.3.1. Goodyear South Africa (Pty) Ltd, Achievement Awards Group (Pty) Ltd, Hippocampus, Hi-Q Automotive (Pty) Ltd (“Hi-Q”) (together the “Organisers”); and

1.3.2. Hi-Q franchisees in South Africa (the “Hi-Q Outlets”).

1.4. The price specials for the Promotional Tyres during the Promotional Period are inclusive of fitting, but exclude wheel balancing, wheel alignment, valves and any other services offered by the Hi-Q Outlets.

2. Eligibility to receive an awardscard®

2.1. To be eligible to receive an awardscard®, a customer must:

2.1.1. purchase a minimum of two (2) Goodyear branded tyres, size 15” or larger (“Promotional Tyres”, as further described in paragraph 2.3 below), in a single transaction at a Hi-Q Outlet during the Promotional Period; and
2.1.2. have them fitted instore at the time of purchase.

2.2. The awardscards® will not be offered to the customer for any wholesaling or interbranch transfers.

2.3. During the Promotional Period, a customer will receive one awardscard® loaded with a R200.00 credit for every two (2) Goodyear branded passenger or SUV tyres, size 15” or larger, purchased during the Promotional Period, as shown in the table below:

3. Rules for the use of the awardscard®:

3.1. To reduce the risk of fraudulent activity on the awardscard®, the awardscard® will be sent to the customer in an inactive state.

3.2. When the customer receives the awardscard®, the customer must activate the awardscard® by logging onto and must sign it on the back in ink where indicated.

3.3. The awardscard® is only valid for the period printed on the face of the awardscard® (the “Validity Period”).

3.4. The awardscard® may be used during the Validity Period to pay for goods and services at South African Card Merchants who accept MasterCard®. If a Card Merchant who displays the MasterCard® logo fails to accept the awardscard®, the customer must immediately report this to the Customer Service Line on 0860 11 6666.

3.5. Customers must present the awardscard® at the time of payment to the Merchant.

3.6. Any complaints regarding goods or services purchased at a Merchant must be addressed directly to the Merchant.

3.7. Customers will not be charged any fees on any purchases made at selected Card Merchants using the awardscard®.

3.8. An awardscard® is not transferrable, exchangeable or redeemable for cash, either in whole or in part.

3.9. A customer will not earn interest for funds available on the awardscard®.

3.10. The awardscard® cannot be used:
3.10.1. for ATM transactions;
3.10.2. for bank teller transactions;
3.10.3. to pay for goods or services over the telephone or Internet;
3.10.4. Cash Back services at a Merchant’s cashier;
3.10.5. to pay toll-fees; or
3.10.6. online shopping via the Online Catalogue of Awards.

3.11. For legal reasons and owing to the risk of fraud, the awardscard® may not be accepted at certain casinos.

3.12. Neither the Organisers nor the Hi-Q Outlets will be responsible or liable in any way to the customer or any third party for the quality, safety, or any other aspect of any goods or services purchased from any Merchant with the awardscard®.

3.13. Certain Merchants will allow customers to use the funds in the awardscard® account towards a portion of the full purchase price of the goods or services in conjunction with another form of payment (e.g. cash, credit card etc.) This arrangement is at the sole discretion of the Merchant and neither the Organisers nor the Hi-Q Outlets shall incur any liability whatsoever arising from this arrangement between the Merchant and the customer.

3.14. In the unlikely event that the awardscard® service is unavailable, the customer may be unable to use the awardscard® or obtain information about their awardscard® balance. Neither the Organisers nor the Hi-Q Outlets shall incur any liability whatsoever for this occurrence. Should an outage cause a transaction to be declined after the amount has been deducted from the awardscard®, the amount will automatically be refunded to the customer, which can take up to 7 working days.

3.15. The customer is responsible for the safekeeping of the awardscard(s)®. In the event that the awardscard® is damaged, lost or stolen, or used by someone other than the customer, the customer must immediately report this to the Customer Service Line (0860 11 6666). No refunds will be provided for amounts debited from the lost/stolen awardscard® in the period between the loss and the reporting thereof to the Customer Service Line.

3.16. In line with banking regulations, the Organisers may change the terms of, or add new terms to, these Terms and Conditions at any time and without giving notice, in accordance with applicable law.

3.17. If the awardscard® is no longer in use or the Validity Period has expired, the customer must destroy it by cutting it up.

4. General

4.1. In the event that any dispute arises with regard to the Promotion and/or the Promotional Rules including the interpretation thereof, the decision of the Organisers is final and binding and no correspondence will be entered into.

4.2. The Promotion is conducted in accordance with the laws of the Republic of South Africa. Should any of these Promotional Rules be deemed void or unenforceable, then that rule will be deemed to be deleted and the remaining rules will remain in force.

4.3. The Organisers reserve the right to amend these Promotional Rules in their sole discretion should they consider this appropriate, before the Promotion closes, and any such amendment(s) shall be posted on the Hi-Q website

4.4. The customer acknowledges and hereby consents to the Organisers and the Hi-Q Outlets collecting certain personal information about the customer for the purposes of this Promotion, including the customer’s identity/passport number and contact details such as telephone number(s) and email address(es). The Organisers and the Hi-Q Outlets undertake not to sell or share this information to or with third parties but may disclose the information if required by law.

4.5. The Organisers and/or and the Hi-Q Outlets may require the customer to be identified and photographed and may publish such photographs in print and/or social media, or to appear on radio and television, when accepting the awardscard(s)® or after having received the awardscard(s)®. The customer will be given the opportunity to decline the publication of their images and to participate in such promotional marketing material.

4.6. The Organisers reserve the right to cancel, suspend or terminate the Promotion at any time. The Organisers shall have no liability whatsoever to the customer and/or third party arising from or as a consequence of such cancellation, suspension or termination.

4.7. To the fullest extent permitted by law:

4.7.1. neither the Organisers nor the Hi-Q Outlets shall be liable for any: claims, damages or losses (whether direct, indirect, general, special, incidental, consequential or punitive), expenses or costs (including, without limitation, costs on an attorney and own client scale) or injuries of whatsoever nature (together referred to as “Losses”), suffered by the Customer or any third party arising from or as a result of this Promotion (whether directly or indirectly) and/or the customer’s participation in this Promotion ; and

4.7.2. the customer indemnifies and holds harmless the Organisers and the Hi-Q Outlets against any Losses, howsoever caused or arising.

4.8. To the fullest extent permitted by law, the customer accepts and uses the awardscard(s)® at the customer’s own risk and expressly agrees that the neither the Organisers nor the Hi-Q Outlets will be liable in any way for any costs incurred by the customer in claiming their awardscard(s)®.
